Clicker Dog Training - 3 Simple Steps to Effectively Teach Owners and Their Dogs!

Clicker dog training is widely considered to be one of the most effective methods used today in controlling and managing a dog's behavior.

When it comes to teaching them basic commands, it really takes very little time to grasp the principles and techniques of clicker training, and when utilising a good quality clicker, you will be able to see results in a very short time, regardless of the kind of dog you're training.

?

How Clicker Training Works

?

The general principle behind clicker training involves creating an association between the clicker sound and a particular command, and teaching your dog to recognise this association. When the dog responds correctly to any given command, they are rewarded with the sound of the clicker. The result is that specific, desirable dog behaviors are then marked.

?

Obviously, you first need to teach your dog that the clicker symbolises a reward for their good behavior and this can be helped along with the use of dog treats, and of course, a clicker purchased from your local pet shop.

?

An important note to mention here is that your dog should not hear the noise of that clicker except to let them know that they have done a good job and that they are about to receive a treat. In the early stages of training, if you use a verbal command at other times without use of a clicker, they may not respond as quickly because the association is not as strong between command and reward as it is between command, clicker and reward.

Clicker Dog Training - How It's Done

?

Clicker dog training comprises of 3 basic steps. Initially, you need to get the dog to perform the correct behavior, in other words, convince them to do what it is you want. This may involve getting them to either sit, stay, come, roll over, or whatever trick you know will be easiest to get them to do first. As soon as they perform this behavior, immediately mark it with the clicker and their favourite reward.

?

Usually, you will see results after only 2 or 3 markings. Your dog will understand quickly what it was they did, and will start to repeat that correct response whenever you use the clicker. Clicker dog training is so successful because the dog's immediate response to your command means that you can reward them straight away, reinforcing the association in the dogs mind. Using a verbal command on its own, without the use of a clicker, will take longer for the dog to grasp.

?

In the following days and weeks, continue this process to reinforce your dogs correct responses as much as possible. Making sure to always use the clicker, you can substitute the use of treats as rewards from time to time with lots of praise and petting. Your dog will appreciate this just as much and will eventually forget to expect a treat for their behavior.

?

Making the Transition to a Command

?

Once your dog is an A-Grade student and has mastered good behavior, you can make the transition to a verbal command that you can use anytime, anywhere, with or without a clicker. Whenever you choose to use the clicker, make sure to say the command, followed quickly by a click, and finished up with a reward. Your dog will very quickly learn to associate these 3 steps.

?

Progressing on from good clicker dog training, your dog will readily respond to verbal commands and praise at the drop of a hat and will simply learn the command.

?

There will be no further need for either the clicker, dog treats or praise, as your dog will instinctively know what the correct response is to any given command, and that it pleases you.

?

As you can now appreciate, there are many applications for clicker dog training. With a simple, sharp command, you will be able to mark and reinforce practically any behavior you want.

Extension of benefits for out-of-work Alabamians in limbo

Published: Monday, November 29, 2010, 10:51 PM ??? Updated: Monday, November 29, 2010, 10:52 PM

Extended unemployment benefits that last week paid a total of $13 million to 56,000 out-of-work Alabamians will start phasing out next week if Congress doesn't reauthorize them, state officials said today.

Without reauthorization, someone filing for jobless benefits now could collect them continuously for no more than 26 weeks, a far cry from the 99 weeks of benefits that some Alabamians have collected since federally financed extended benefits started in July 2008.

The state of Alabama pays jobless benefits for the first 26 weeks a laid-off worker is out of work and seeking employment. After that, the federal government since 2008 has picked up the tab for more and more extended benefits, up to an additional 73 weeks.

The extended unemployment benefits since 2008 have paid unemployed Alabamians a total of $1.27 billion, state officials said.

So far, about 17,700 Alabamians have received 99 straight weeks of unemployment compensation thanks mainly to the federally financed extensions, said Hoyt Russell, head of the unemployment compensation division of the state Department of Industrial Relations.

The extended benefits wouldn't end all at once if Congress doesn't act. They are awarded in tiers, or segments, as short as six weeks and as long as 20 weeks. Starting next week, if Congress doesn't act, many people will be able to exhaust all the benefits available from the tier they're in now but won't be able to move on to collect another tier of benefits.

Some people are in the last, six-week-long tier of benefits and would stop getting payments anyway because they will have gotten 99 weeks of benefits at the end of that tier.

But without reauthorization, as many as 50,000 people now collecting extended benefits won't be able to move on to the next tier of benefits, said Tom Surtees, head of the Department of Industrial Relations.

Also, without reauthorization, the roughly 34,000 people still in the first 26 weeks of benefits provided by the state won't be able to get any federally financed extended benefits. If they use up 26 weeks of benefits they won't get any more if Congress doesn't act.

Congress let extended unemployment compensation benefits lapse earlier this year before approving an extension in July, and people who missed weekly payments received lump sums to make up for it.

But Surtees said he had no idea if or when Congress will once again extend unemployment benefits in Alabama and other states to a maximum of 99 weeks. "I have none," he said.

People whose benefits phase out because of inaction by Congress should keep certifying each week with the department, by phone or online, whether they're still jobless and still willing to take a full-time job, industrial relations spokeswoman Tara Hutchison said.

She said resumption of payments, if Congress once again extends benefits retroactively, would be much easier for people who keep certifying with the state.

"We'd like to encourage everyone to file their weekly certifications so that in the event Congress does re-extend the extensions, DIR will already have all the information on file. It will allow the department to pay benefits more quickly," Hutchison said.

Training Bulldog Puppies - A Study in Stubborn Bulldog Personality Vs Proper Obedience Training

Training Bulldog Puppies

?

Bulldogs have to be one of the oldest, most elite, pedigree breeds of dogs in modern day society.

Since way back in the 1500s, Bulldogs have been a symbol of England, being generally brave, stoic and strong-willed. Hence, training a bulldog pup is usually a bit of a chore if your puppy is particularly pig-headed or inquisitive in your house.

?

Choosing Your Puppy

?

When choosing your Bulldog pup, be aware just how much general characteristics and traits make up this breed. Bulldogs are prone to numerous health problems, starting from the moment they're born with a high rate of mortality. Pick out a puppy that's not less than 8 weeks of age, is not at all aggressive and has a friendly nature. Ensure it's in excellent condition with your vet, as there are a number of puppy-related health conditions that your bulldog puppy might have, especially with its ears or nose.

?

Training should commence from the moment your puppy is brought home, but, only if your dog is old enough and has had ample opportunity for socialization. If your puppy isn't 10 weeks old, or it's not been properly socialized with children, adults and other pets, especially dogs, be sure you do this as soon as possible to prevent the development of any unnecessary aggression issues.

?

Bulldog Puppy Training

?

When your puppy is old enough, start training with basic housetraining or house-breaking. Bulldogs can often be especially stubborn when young, so it's strongly recommended that you utilize crate training from the start, and that you are home as much of the time as possible during house breaking. It will take a little longer than normal to complete the process of housebreaking, but once your puppy is broken, you will find that he is very careful never to make a mess in his home. Once you've established the basics, start creating an environment where you are the obvious and un-challenged alpha pack leader. Train your puppy not to nip or bite, using toys and a whining noise to indicate that it hurts. Don't let your puppy jump on the furniture and never allow it to sleep in your bed. The crate should be used as often as possible in these first months at home as you stretch out how long your puppy stays in there.

?

Bulldog puppy training ought to move into the obedience phase somewhere between 3 and 6 months with concentration on simple commands like lie down, sit, stay, come (when called), wait, learning how to focus on you, and not pulling on the leash.

?

You will discover that a Bulldog can be quite skilled at tuning in to these cues, but may not initially want to follow your lead owing to its stubborn nature.

?

Using Bulldog Puppy Training to Protect Them

?

Because of their inborn curiosity and plucky nature, a bulldog puppy will try and explore as much of its home and the great outdoors as possible. Train them early never to chase vehicles, to stop and wait at the curb and to make sure they never run away from you when out in public. Never take a bulldog off its lead until you can be certain it's going to return when called and that it won't run too faraway from you. The dangers are generally higher with Bulldogs than they are with many other small dog breeds

?

Proper Bulldog puppy training may appear somewhat harder than normal when you first bring home your new little buddy, but in the end you will find that Bulldogs are amongst the most loyal, attentive dogs you could ever own. They will stay stubbornly by your side, following your commands and staying clean indoors. But, only if you introduce the rules early on and make sure they follow your instructions not just for a while, but always.

Archivist Marvin Whiting remembered for making Birmingham's history accessible

Published: Sunday, November 28, 2010, 7:02 PM ??? Updated: Sunday, November 28, 2010, 7:04 PM

It wasn't unusual to find Marvin Whiting digging through the trash at downtown Birmingham businesses looking for scraps of the city's history before they were lost forever, friends said today.

Mr. Whiting, who served as director of Birmingham Public Library's archives department from 1976 to 1996 and was curator of the Birmingham-Jefferson History Museum, died Friday. He was 76.

"He was kind of an evangelist of archives and history," said Robert G. Corley, director of the Global and Community Leadership Honors Program at UAB, who once worked for Mr. Whiting.

In fact, Mr. Whiting began his professional career as a Methodist minister. He had a master of divinity from the Candler School of Theology at Emory University, a doctorate degree in American religious history from Columbia University, a master's degree in history from Emory University, and a degree in library science and archives from Emory University.

After serving as chaplain and assistant professor at Jacksonville University in Florida the Georgia native came to Birmingham to direct the library's archives department.

Marjorie White, director of the Birmingham Historical Society, credited Mr. Whiting with developing the first major program for collecting and preserving the city's records and opening them to the public. "For the life of a city, that is very important to have access to records to tell your story," she said.

Mr. Whiting sought out records anywhere they could be found, developing contacts at long-time area companies to get them to turn over their records before they were lost. He even was known to go through the trash of some older businesses that were moving out, friends said.

Among the records added to the city's archives during Mr. Whiting's tenure were records from the Elyton Land Co., which founded the city of Birmingham, and Jemison & Co., another development company that developed Mountain Brook, Fairfield, and a number of commercial buildings and hotels in Birmingham, including the Tutwiler Hotel in downtown Birmingham.

"He (Mr. Whiting) was driven to collect things," White said.

Industrial Sector- Taking Nation On The Path Of Development

Industry is linked with production of goods with economic mode. Industrial sector is moving toward new heights with advancements in technology and newer techniques. There are four types of segments, primary, secondary, tertiary and quaternary sector.

The industrial revolution ushered a new era in industrial sector, it led to production of goods at large scale. Before such revolution the machine used for producing products was of older technique. Industrial revolution resulted in change in equipment and technique used in producing products. Specialization in labor resulted in skilled workers. This led to increase in production and lowering the cost of products. Development of latest tools and equipment increased the output of products.

Wars also increased the output. With mass production of weapons and supplies the whole concept of war altered.

Now the focus of industries was on producing better weapons that could lead to victory in battles.

The status of industry also depends on the current trends prevailing in the market and the social environment of the nation. If the country is facing situation like war, the production would also be inclined towards it.

Industry is also a big source of income and provider of jobs to the local population. If the nation has good and efficient industry it would open for jobs for skilled as well as unskilled labor.

The economy is deeply connected with industry and economy is divided into public and private sector.

The duration of industry depends upon factors such as change in technology and evolution of newer technology. The quality of products manufactured also determines the life of industry.

If the products manufactured are of superior quality and are designed according to need, the industrial sector is likely to grow and develop.

Primary one deals with raw material like mining and farming. The secondary deals with construction, manufacturing and refining. The tertiary segment deals with services like law and medicine and quaternary is connected with technical design. Industrial sector is part of our society and countries and government also require having policy in order to regulate the segment.

Industrial sector is divided by government into three main sections, agriculture, manufacturing and services. The agriculture one actually deals with agriculture products and raw materials. The manufacturing industry deals in designing products from raw material and it is basically designing sector. The services section is mainly dealing with R&D that is research and development. R&D is the most important and prosperous branch of industrial sector, it is responsible for developing new methods and technique in order to boost production.

The Best of Each Genre

It’s hard to say what the best PS3 games are because many of them target different audiences, so it clears things up a bit if we say what the best ones are for each genre. That way knowing what you already like in a game will point you in the right direction.

For straight up action games, the best PS3 games are Grand Theft Auto IV and Resistance 2 (you can also pick up the original Resistance, often at a huge discount anymore, although it is not as good as its sequel). While it’s not out quite yet, the early reviews of Killzone 2 are all nothing short of amazing, and when that game goes to retail, it’s safe to assume that it may see such popularity that is only found in games like Halo 3 for the 360.

Unfortunately, if you want good strategy games, you’ll have to go to the PC for the good stuff, as you will for MMOs. That’s because those games work better with a keyboard and mouse, which don’t have widespread acceptance on consoles yet. However, there are several other genres that have the best PS3 games in them yet.

For fighting, check out the newly released Street Fighter 4 (it seems like the PS3 has a lot of the fourth generation titles from franchises – Metal Gear Solid 4, Grand Theft Auto 4, Street Fighter 4, etc.). If you’re looking out for a good RPG, look no further than the upcoming Final Fantasy XIII, sure to be as good as all of the others with Square Enix’s track record for Final Fantasy titles. Other titles like Little Big Planet round out the mix for a balanced game library. While figuring out which games should be at the top of your list, always look to the best PS3 games first.

In the event you want to create your personal website, regardless of whether it is for your business or perhaps a private website, you will require to think about what kind of internet host you will require. What Type of Web Hosting do I Require?

Unfortunately, there is no simple reply. The kind of web hosting services you need will very much depend on what kind of web site you intend to produce. On one palm, in the event you plan to design a person web site, which won’t receive significantly traffic and has no complex specialized additions, then a free internet hosting services (supplied by your ISP) should be ample for the wants.

Nevertheless, it is worth bearing in mind that the services offered by these providers is limited and, moreover, it’s subsidized by marketing revenue.

On the other hand, in case your internet design has audio, visual, and/or will probably be downloaded from, then you will definitely require to search for a web hosting business that provides the appropriate disk space and bandwidth to run that kind of website. Similarly, if you’re establishing a company website, you will almost certainly need much much more than a totally free host service can supply.

Discount Web Hosting

That said, a great web host does not need to become expensive. Actually, because of the numerous web hosting companies, there are lots of bargains and discounted packages to become had.

Finding a great deal on web hosting demands some patience and study on your part, but, more importantly, you need to understand exactly what the technical specifications are for your website and what kind of hosting package is right for you personally or your business. To find out more about affordable hosting plans, please visit http://hostgatorcouponcode.org

HostGator is an amazing web host that I would recommend. With unlimited bandwidth, unlimited drive space and hosting for unlimited websites, their features are hard to beat. With the use of Hostgator coupon, it will make hosting even cheaper, with your first month only costing a penny. Visit the site for the latest Hostgator coupon code for more hosting rebates.

Ex-two-year college chief Johnson to get pension in prison

Published: Sunday, November 28, 2010, 6:00 AM

Former two-year college Chancellor Roy Johnson begins serving a 6????-year prison sentence for bribery, conspiracy and other federal corruption charges next month, but he'll still be getting paid by the state.

Johnson and the state of Alabama contributed to his pension as he worked about 20 years in state education. He's now drawing $132,000 a year from the Alabama teacher retirement system, a state retirement official said.

Johnson isn't the only former public official or employee in Alabama in line to collect a government pension after being charged, convicted, or having pleaded guilty to public corruption charges.

Twenty former public employees who either committed crimes or are charged with crimes while on the job are due to receive more than $1 million a year in pension payments before taxes or other deductions, according to records provided by the Retirement Systems of Alabama, the General Retirement System of Jefferson County and federal court.

In at least two cases, the federal government has garnished up to a quarter of the pension amounts following sentences resulting from probes into the state's two-year college system and Jefferson County's sewer system. The federal government also is asking for garnishment of one other pension.

Birmingham lawyer Bart Slawson said the state Legislature or County Commission should attempt to get the pension obligations canceled for people who committed crimes for personal gain working for two-year colleges or Jefferson County.

Slawson represents a group that won an environmental lawsuit to force Jefferson County to fix its leaky sewer system. The work resulting from lawsuit settlement became the central focus of the county sewer corruption scandal.

"They don't deserve them (the pensions) and they should be disgorged as unjust enrichment," he said.

Among the long-standing ideals for pensions is that you provide your employer with loyal and valuable service, "not committing illegal acts to damage your employer, and that's exactly what these guys did," Slawson said.

Don Yancey RSA's director of benefits, said if an employee works at an institution and makes contributions, they can get their pension once they meet eligibility requirements. "A criminal conviction does not do anything to eliminate a person's eligibility for a pension if they've earned a pension," Yancey said. "It doesn't matter whether that offense was related to your job."

Under the RSA's teacher retirement plan, employees like those convicted in the two-year college scandal contribute 5 percent of their pay to their pensions. The amount that the state contributes each year varies but is currently equivalent to currently 12.5 percent of the person's salary, he said.

Under the Jefferson County system, each member contributes 6 percent of his or her compensation, according to the system's attorney, Beth Beaube. The county matches that contribution.

Eight former two-year college employees who were either convicted or pleaded guilty in the federal investigation get pensions ranging from $11,005 to $1,032, or about $440,000 a year combined, from the state retirement system.

Johnson gets the most, $11,005 a month, and will continue getting it while in prison. Former state Rep. Sue Schmitz draws the smallest pension, $1,032 a month.

Five people who committed crimes in the Jefferson County sewer scandal collect pensions ranging from $3,805 to $2,174, for a total of about $240,000 a year, from the county's retirement system. Two other former county employees who pleaded guilty in the sewer scandal -- Harry T. Chandler and Donald R. Ellis -- will be eligible for pensions when they turn 60, according to county pension system records.

Chandler, Jefferson County's former assistant director of environmental services, will get $5,140 a month. Ellis, the environmental department's former senior civil engineer, will get $2,526 a month.

Two officials covered by the Jefferson County retirement system and convicted in the sewer scandal elected to get a refund of their own retirement contributions when they left the county's employment, the records show. They will not be get a county pension.

Former Jefferson County Commissioner Larry Langford got a refund of $21,076 and former employee Ronald K. Wilson collected a refund of $29,322, according to the retirement system. Langford is now serving a 15-year prison term on public corruption charges. Wilson was sentenced to 13 months in prison.

Courts and prosecutors do have a way to take part of the pensions of people convicted of crimes.

A court order is required to allow the government to take part of a person's pension to pay toward court-ordered fines and restitution. The Consumer Credit Protection Act limits the garnishment of wages to 25 percent of a pension, except in certain circumstances including child support

In one case in the two-year college probe, former state Rep. Sue Schmitz had her retirement credit taken away for her work with a state program for troubled youths after her conviction, Yancey said. She had been convicted of charges relating to a no-show job with that program.

Schmitz kept her retirement credit for her career as a public school teacher, Yancey said.

Federal prosecutors have garnished up to 25 percent of the monthly pensions of a few of the convicted officials pension to repay court ordered fines, or restitution.

Those who have had wages garnished in the two-year college or sewer scandals include:

Jack Swann, former head of the Jefferson County sewer department, who had his $6,928 gross monthly pension garnished at a rate of 25 percent by federal prosecutors.

Robert Nix, former deputy director of the Alabama Fire College, has a garnishment of $928 a month off his $4,394 a month pension, also about 25 percent.

The U.S. Attorney's Office also has asked to garnish the $2,198 a month pension of former Jefferson County Commissioner Chris McNair. The garnishment has not been finalized, said McNair's attorney Doug Jones.

Federal prosecutors have not sought to garnish the pension of Johnson, who has been ordered to pay $18.2 million in forfeiture and give up his house in Opelika.

Peggy Sanford, spokeswoman for the U.S. Attorneys Office, said it's premature to comment on what steps may be necessary to collect forfeiture in the Johnson case.

Birmingham-area children's wishes on Salvation Army's Angel Tree getting granted slowly

Published: Saturday, November 27, 2010, 1:00 PM
A frilly gray and multi-colored striped pants suit and light blue and indigo jeans were just a few of the items that Libby Kiyak plucked from the children's section in Belk on Friday.

Kiyak, who normally shops at Walmart on the busy shopping day, stopped at Colonial Brookwood Village with a goal to fulfill a child's wishes on the Salvation Army's Angel Tree. Her shopping excursions will mean a 5-year-old girl with special needs will have gifts to open this Christmas.

"This'll be cute," she said eyeing her choices. "Now, I need some pajamas. Everybody needs a nice warm pair of pajamas."

A pink flannel set decorated with gingerbread characters and candy canes caught her eye.

"Oh yeah, that's real cute," she said.

"Another thing that I like is this gives me a chance to shop for girls. That's something I never get a chance to do," she said pointing out she has sons. "The girls' clothes are a lot cuter than the boys."

Kiyak said her shopping will continue next week, but she will have a little help from her boys.

"I told them I want them to go shopping with me," she said. They will shop for the family's angel using their own allowances. "I think it hits home with them more rather than if I just pick things up for them. They want to do that. They want to help."

Kiyak is among what Salvation Army volunteers at the mall said is a smaller amount of Angel Tree participants Friday at the mall.

By afternoon, tables at the Fox 6 Gifts for Kids Salvation Army Angel Tree at Colonial Brookwood Village were still stacked with unclaimed cards bearing the names of Angels yet to be adopted. The Christmas trees beside them remained crowded with Angel Tree tags waiting for shoppers' hands to pick them and fill the wishes written on their cards.

"It's been very slow," said Doris Adamson, a member of the Salvation Army Auxiliary who was volunteering at one of the tables. "Unless it's the weather or the (Iron Bowl) game, I'm not sure what it is."

Despite the slower crowd, Kiyak said she is glad to help.

"It's just fun to know that you're going to be a part of someone's holiday," Kiyak said. "I hate the thought that a child may not have a Christmas."

Kiyak said she has considered helping out at the Angel Tree tables.

"That way, not only can you buy things, you can volunteer your time," she said.

Personal Injury Law

Any time a person is injured, that person experiences a personal injury. The law is designed to protect an individual from being harmed by other people or organizations. If a person experiences harm as a result of the actions of another person or organization, that person can file a personal injury claim. The claim will involve an attempt to demonstrate that either through negligence or as a result of willful or inadvertent actions, the person or organization caused the personal injury experienced by the aggrieved party.

The personal injury can happen by any of the following scenarios

1. A car accident: If someone runs a stop light or they hit you in another manner, this is grounds to seek the assistance of a personal injury lawyer. You did not ask to be hit by that individual. They were not paying attention to what they were doing, so it is only right that they make sure you are taken care of.

However, you may have to take it to court in order to get the compensation you need for your pain and suffering, medical bills, and lost wages.

2. Animal bites: Animal attacks result in more than just bites and scratches. There is the fear of diseases, such as rabies. There is also the possibility of disability. This also results in lost wages and pain and suffering. Extensive surgeries may also be needed to repair the damages as much as possible.

3. Slips and falls: This is something that tends to happen on personal property. For example, the department store may not have properly blocked off a spill. An individual then steps in the wet area and they fall. Another example is a store that has left an obstacle in the aisle that was not seen.

This can result in severe injury. Individuals can find themselves suffering from broken bones, severe sprains, tears, and even whiplash when this occurs.

4. Personal attacks: A personal attack is when an individual is attacked by another person. This could be a fight that renders a person disabled. If they have to have expensive medical attention, have lost wages, or are permanently disabled, this is grounds to see a personal injury lawyer.

5. Any injury on personal property: If you are on someone's personal property and you become injured due to something that exists upon that property that the owner should have taken care of, see a personal injury lawyer. This could be anything from not taking care of ice on steps to falling through a weak floor and many more.

When you go to see your personal injury lawyer, you present them with evidence that shows that someone else was at fault. This includes any medical records, police reports, and anything else that you have to prove your case.

Once the personal injury lawyer evaluates the information, they are able to determine whether or not you have a case. If they do determine that you have a case, then they will take the next step in finding more information. From there, they will notify the proper entities of the lawsuit and file it in court.

From there, a court date will be scheduled and it will be time to prove your case so that you can receive the compensation that you need. This compensation is used to replace any monetary losses you have experienced because of the injury.

Personal Injury Attorney

Personal injury lawyers commonly are consulted by a potential client who has been seriously injured or who has suffered catastrophic injuries as the result of the breadth of negligent conduct, from an auto accident or bicycle or pedestrian or motorcycle accident to medical malpractice, a product defect, food poisoning, or a defect or failure to maintain commercial or residential premises.

While "liability" in some cases may be simple, such as the auto accident lawyers establishing through witness testimony that the defendant driver ran the red light, the presentation of the damage case in every serious injury case is complex. Specific injuries sustained in auto accidents or premises liability cases, such as traumatic brain injury (TBI) or spinal cord injuries resulting in paralysis, Damages in Catastrophic quadriplegia or paraplegia, and the resulting loss of enjoyment of life, can be as complex to present by personal injury lawyers as the evidence of Hemolytic Uremia Syndrome HUS in a food poisoning case, or cerebral palsy in an obstetrical medical malpractice case.

Furthermore, speaking again just in terms of the client's "general damages," the personal injury lawyers must use appropriate strategies to convey to the settlement judge or jury the life consequence of the serious injuries.

Many personal injury attorneys refer to "general damages" as "pain and suffering," but often the most persuasive strategy can be framed in terms of "loss of enjoyment of life." One way that lawyers will present their clients general damages is by eliciting the testimony of the client, his family and friends, as well as photographs and home movies demonstrating all the activities that the client enjoyed most in his life before the accident, juxtaposed against a "Day in the Life" film, commissioned by the personal injury lawyer to demonstrate the courage of the seriously injured client as he confronts all of the obstacles and challenges presented by his daily life.

The personal injury lawyer must also present the client's "special damages" including his past and future medical expenses and past and future loss of earnings or earning capacity.

Past medical expenses are often easy to prove, simply gathering and summing all medical bills accumulated from the date of the accident through the date of the settlement conference or trial. Future medical expenses are much more complicated for personal injury attorneys to present, usually requiring the testimony of a number of medical experts, a life care planner and a forensic economist. Very briefly, the life care planner consults with the treating and the medical experts hired by the serious injury attorneys to arrive at the client's life expectancy and itemize all of the medical expense, from additional surgeries to convalescent home or rehabilitation expense, to replacement prostheses or wheel chairs to medical supplies that the client will require over the course of his life expectancy. The personal injury lawyer will the present the "life care plan" to a forensic economist who will increase the individual costs over the time period using medical cost inflation statistics and then reduce the total to present value.

In the simplest of cases, involving the hourly wage earner, for example, the measure of past loss of earnings might be relatively easy to calculate, but the measure of future loss of earning is always complex. Again it requires the personal injury lawyer to engage a number of experts, including medical experts, and most importantly a "vocational rehabilitation expert" and forensic economist. The measure of future loss of earnings or earning capacity is the "net" loss, and so the vocational rehabilitation expert generally meets with the client, speaks with the clients physicians and the medical experts selected by the serious injury lawyer, reviews the clients transcripts from the schooling or advanced education he has received, and then provides a report to the lawyer describing the occupations for which the client is, subsequent to the accident, is disqualified to participate in, and the occupations for which he remains qualified. Depending on the client's injury, there may also be a substantial difference between the client's "work life expectancy" before and after the accident. The serious injury lawyers then provide the vocational rehabilitation experts report to the forensic economist, who in turn employs wage rate increase statistics, for the client's occupation before the accident, and in those industries for which he is still qualified to be employed, if any, and applies general inflation statistics to the gross total loss of future earnings to discount to present value.

It is a challenge for personal injury lawyers to properly and adequately present the damage case of the seriously injury client. It is a challenge that must be accepted by attorneys who regularly prosecute complex cases, such as medical malpractice, food poisoning or pharmaceutical product liability cases, as well as auto accident lawyers and premises liability attorneys alike. The special damage issues, which are the commonly the most complex, are the regardless whether the underlying liability is a simple auto accident or complex medical malpractice case. And the damage case requires equal attention, regardless of the underlying liability, by the personal injury lawyer who undertakes any serious injury case.

Lawyer sought to be first federal public defender for north Alabama

Published: Friday, November 26, 2010, 5:30 AM

A federal appeals court is advertising to find a lawyer to become the first federal public defender to represent indigent clients in north Alabama.

People charged with federal crimes in the Northern District of Alabama who can't afford a lawyer are now appointed one from a group of attorneys called the Criminal Justice Act Panel. The district has been one of only four court districts nationwide that doesn't have some form of a public defender office to represent indigent clients.

The United States Court of Appeals for the 11th Circuit Applications began accepting applications for the public defender several weeks ago. That person will lead a 14-member staff of attorneys, administrative employees and other support personnel with offices in Birmingham and Huntsville.

Deadline for applying for the $139,950 a year job is Dec. 17.

"We were happy to learn that the 11th Circuit has begun the process of advertising for the federal public defender for the Northern District of Alabama," said Chief U.S. District Judge Sharon Lovelace Blackburn.

Creation of the Federal Public Defender Organization was approved late last year in a unanimous vote of the district's federal judges. Blackburn said judges also are grateful for the support of the state's two U.S. senators and congressmen within the northern district.

James P. Gerstenlauer, circuit executive for the 11th Circuit Court of Appeals, said he would not expect the public defender to be chosen before the middle of next year. After the application deadline next month, a committee of judges and lawyers will review and interview candidates, he said.

The federal public defender will hire the assistant federal defenders and other staff members for both the Birmingham and Huntsville federal defender offices, Blackburn said.

Birmingham attorney Brett M. Bloomston is one several attorneys on the CJA Panel available for appointment to indigent cases in the Northern District of Alabama. He also is on an administrative committee that acts as a liaison between the panel of attorneys and the court.

Initially some attorneys opposed the creation of a federal public defenders office, Bloomston said. He said there was a don't fix it if it isn't broken mentality. "We just weren't satisfied there was a need for it," he said.

But it's a decision that has been made and "we'll live with it," Bloomston said.

Despite the public defender's office, there will still be a need for the panel of attorneys because the public defenders office likely won't be able to handle the entire workload, Bloomston and others said. Also, there will be times when conflicts of interest within the public defenders office, may require the use of other lawyers.

"We will continue to be utilized," Bloomston said.

Blackburn estimated that the attorneys will still be getting at least 25 percent "and likely more" of the court-appointed cases.

"We are confident that a federal public defender along with the excellent lawyers on our Criminal Justice Act Panel will provide the best possible representation for indigent defendants in the Northern District of Alabama," Blackburn said.

Gabe Watson indicted on two counts of capital murder; his attorney calls charges 'ludicrous ... screwball theory'

Published: Thursday, November 25, 2010, 6:56 PM ??? Updated: Thursday, November 25, 2010, 7:57 PM

A Hoover man recently released from an Australian prison after serving 18 months for manslaughter in the 2003 drowning death of his wife has been charged with two counts of capital murder.

Gabe Watson, 33, arrived in Los Angeles on Thursday morning after he was deported on a commercial flight from Melbourne. He was taken in handcuffs to the 77th Street Community Police Station for booking, and a police lieutenant there said Watson would likely make a court appearance before being sent to Alabama.

Don Valeska, chief of the Alabama attorney general's violent crime division, confirmed Thursday that Watson was indicted by a Jefferson County grand jury on Oct. 22. on capital murder in the course of kidnapping and capital murder for pecuniary gain.

Charges were sealed until Watson returned to the United States.

The indictment lists as count one that Watson caused the death of Christina "Tina" Watson of Helena by drowning her for pecuniary gain or other valuable considerations, proceeds from a life insurance policy, according to Valeska.

In count two, Watson caused the death of Tina Watson by drowning her during an abduction to accomplish a murder, Valeska said.

The indictment states that Alabama prosecutors will not seek the death penalty.

Watson pleaded guilty to manslaughter in Australia, admitting he failed to render aid to his dive buddy -- his wife of 11 days.

Australian authorities had charged Watson with murder but accepted his plea to manslaughter. He was released from prison Nov. 11 but detained in Australia while officials there sought assurances from the U.S. government that he would not face the death penalty should murder charges be brought against him in Alabama.

Brett Bloomston, Watson's Birmingham attorney, said neither charge is a viable theory of prosecution.

Bloomston said his client was not a beneficiary of any insurance policy and said the kidnapping charge is "as ludicrous as it sounds."

"To prove that, the attorney general will have to offer that Gabe tricked Tina into falling in love with him, into marrying him, into traveling halfway across the world and going scuba diving," Bloomston said. "It really is a screwball theory."

Tina Watson's father, Tommy Thomas, said the family has remained confident that Waston would face Alabama charges.

"We believed that the evidence that got him indicted in Australia would also get him indicted here," Thomas said.

Thomas said he hopes Watson will not receive bail upon his return to Alabama.

I would want him to stay in jail because I know if he's out, his attorneys will do everything they can to avoid and delay a trail, but if he's locked up, they'll be eager to get this to trial and get this done," Thomas said.

Bloomston said if it wasn't for Attorney General Troy King, Watson would already be in Alabama.

"The fact is, Gabe will wave extradition to Alabama," Bloomston said. He had requested that King allow Watson to turn himself in, but said the request was ignored.

"What is Attorney General King afraid of?" Bloomston said. "Did Attorney General King fear Gabe would come back to the United States and go find a cave in Montana?"

Why Are Music Lessons So Important When Starting a New Instrument?

One thing that separates aspiring musicians from a few decades ago from their contemporary counterparts is the value of the internet; there are invaluable resources there that would have benefited the players of yesteryear. However, especially when beginning to seriously undertake an instrument, there is absolutely nothing that can come close to replacing the guidance of a professional teacher. This is true for several reasons.

Music teachers are more than a passive resource you try to take from. They listen to you, watch, judge, and speak back to you reflectively. With years of training under their belt, they can quickly identify flaws in a beginner’s technique. Perhaps the most important thing they do is determine what not to learn first. It’s essential that the student be given moderate tasks suitable to their experience, inclinations, and interest level.

Nothing on the internet can possibly take these considerations into account and provide the appropriate lesson. Only a proper teacher can. Depending on these things, as well as the student’s commitment to practice and their desire to challenge themselves, the teacher can construct the ideal lesson. It’s up to a human to judge what the student is capable of, and then to find that proper balance between pushing enough, but not too much.

As well, teachers provide inspiration in the way they play the instrument themselves and the feedback and encouragement they provide. People have seen the most incredible accomplishments on a computer screen somewhere, and after a while they don’t seem or feel real. But when you’re in a room with someone who is actually responsible for the incredible guitar sounds you’re hearing it bridges that gap between fantasy and a potential reality.

In other words, it seems possible to do it yourself.

It’s invaluable having a professional who can utilize the internet’s guitar resources properly. Thinking about it this way, professional teachers have never been given such a chance to make their students succeed! Like everything else, guitar lessons are oversaturated and an unarmed novice is ill equipped to separate the useful from the useless, the appropriate from the overly challenging, and the amateur lessons from the professional tips. To them, it all looks the same.

Some of the reasons for needing teachers are even more basic. Guitars frequently go out of tune, and keeping them sounding right can be a great source of frustration for beginners who don’t know why their chords don’t sound right. Frequently, they incorrectly blame themselves, and their frustration stymies their development. What a tragedy! It’s hard to overemphasize the impact of something so small and trifling. With a teacher, this problem doesn’t exist. There are countless other hurdles students of various instruments can run into—how to properly set up a reed in an alto sax, technique for trumpet blowing. There are innumerable pitfalls teachers help students avoid, thereby saving them time, accelerating their development, and most importantly, making them have fun on their instrument!
